• The European Union proposal on electronic tachographs may be illegal, says the EU's Economic and Social Committee.
The committee, which includes hauliers and trade unions, has expressed doubts about the mandatory installation of an external warning signal if a driver broke EU rules on driving hours. It is questionable whether involving the population at large.., would be consistent with principles of legal certainty,' says the committee.
It says the proposals contradid other aspects of the proposed rules which state that in some cases a driver may drive without his smart card for 15 days. The committee believes drivers who are exempt from the rules which normally impose an 11-hour rest period could be Falsely accused by the public of breaking drivers' hours .
