taken the shine off the firm's green record after it was fined for polluting a local pond with diesel.
The Chester-le-Street-based firm pleaded guilty to letting the fuel spill into Penny Town Ponds. Somercotes on10 September 2003; it was fined a total of £10,000 with £750 costs.
Ilkeston magistrates heard that the EnvironmentAgency received a report of oil pollution on the pond. An officer visited the site and found the oil appeared to be flowing from a surface water sewer, which was traced back to ACC's depot at Garnham Close.
Officers visited the site and found that underground fuel tanks had recently been brought back into use. Diesel had leaked from the tanks into a water sewer, and from there into the pond.
For the company. Michael Burrell told the court that the underground tank system, installed by a previous occupier of the site, had a leak or fault that was unknown to his client and that ACC had spent a substantial amount on fixing the problem.
Speaking after the case. EA officer Louise Gorman said: "Companies dealing with materials which pose a threat of pollution must ensure that they are handled in a way which minimises the risk of pollution."
