%YJHERE an established business VT sought to replace vehicles held under special A licences with others under ordinary A licences, a Licensing Authority would be justified in thinking that a prima facie case had been established if the applicants produced turnover figures, or evidence of tonnages carried, to enable him to form an opinion as to whether the existing vehicles were reasonably fully employed.
Also, the carrying capacity of vehicles to be authorized under ordinary A licences should not differ substantially from that of the specialA licensed vehicles.
This was stated by Mr. Hubert Hull, president of the Transport Tribunal, on Tuesday, when the Tribunal rejected an appeal by the British Transport Commission and David MacBrayne, Ltd., against a decision of the Scottish Deputy Licensing Authority. The Authority had granted an A licence to Highland Haulage, Ltd., Inverness, to operate a number of articulated vehicles, aggregating 21 tons unladen, subject to the surrender of a special A licence for five rigid and two articulated vehicles,
