DRONFIELD magistrates last week listened to the bell-like signal of art ice-cream van to decide whether it were a "noisy instrument." They then fined the user £1. He is to appeal.
Selby Douglas Wright, 15 Snape Hill, Dronfield, pleaded not guilty to a summons brought under a section of the Local Government Act, 1933, which reads: "No person shall, for the purpose of hawking, selling or distributing any article whatsoever, shout or use any bell, gong, or any noisy instrument in any street in such a manner as to be, or to cause a nuisance or annoyance to the residents of any such street."
Mr. Max Mather, defending, said that there had recently been a number of similar prosecutions, all of which had failed. In one case, Sheffield Quarter Sessions Appeal Committee held that thc defendant had no case to answer.
