• The Civil Penalty Prevention of Clandestine Entrants: Code of Practice is the main guide to follow. This is due to be reviewed.
• Fines are imposed when a driver and/or company fails to have an effective system to protect vehicles being used by clandestine entrants or fails to operate the system properly.
• The driver of the vehicle, driver's employer and the owner or hirer of the vehicle can each be fined up to a combined maximum of £4,000 per stowaway.
• The Home Office also operates a Civil Penalty Accreditation Scheme for companies that can show that they operate an effective system. This means penalties are not imposed on them, even if clandestine entrants are discovered in their vehicles. Companies that operate effective systems for the prevention of clandestine entry are encouraged to join this scheme.
