A FORMER TNT employee has lost a claim for age discrimination, after he was retired at the age of 65.

He has, however, been allowed to pursue a separate claim for unfair dismissal.

Peter Lynn of Wilnecote. Tamworth, Staffs, was told by Ann Coaster, judge at Birmingham Employment Tribunal, that his claims for age discrimination and unpaid wages against TN I' Express Services of Atherstone had failed.

The claim had been unsuccessful because of a technicality. Lynn. who worked loading vehicles, had not made details of his claim clear enough in his grievance letters to the firm. said the judge.

She added that he could still go ahead with his other claim, which was for unfair dismissal.

Lynn, 66. had been employed for seven years at TNT's huh at Kingsbury. Staffs.

He said he lost his job the day before he turned 65 after the firm said he had reached retirement age and would not he allowed to work on.

The firm denied me my basic right to carry on working past 65,said Lynn. "They stopped providing training for promotion to me and another employee when we were over 63 at the time, and I was also moved around many times in my job. which was a form of victimisation.

"I have been treated less favourably than others because of my age this is age discrimination.he alleged. Cyril Adjei, representing TNT, opposed Lynn's claim for age discrimination because he had not made his claims clear enough in his grievance letters to the firm.

The judge said it was an essential part of tribunal regulations that claims were clearly defined in grievance letters to respondents.

"Unfortunately, your claims were not made clear and your claims for age discrimination and unpaid wages are rejected."

Lynn's otherelaim for unfair dismissal will he heard later this year.
