A regulation replacing Directive 96/26/EC will establish common rules for access to the road transport industry, and shall include: • the new regulation to apply from 4 December 2011; • part-time transport managers will be limited to four operations and a total of 50 vehicles; • transport managers from accession states where no CPC had previously existed before joining the EU are offered a concession (Romania and Bulgaria, for example, joined in 2007). If they have continuously managed an operation for 10 years before 4 December 2009, they may be exempt from CPC examination; • CPC holders who have been out of the industry for five years could be asked to demonstrate an update of knowledge, which need not be a test, although it could be. The method is up to each member state; • accreditation of training organisations: • financial standing of €9,000 for the first and €5,000 for each additional vehicle. In the UK, the sums are to be reviewed annually against the euro, rather than the previous five-yearly review; • national electronic registers of operators. including details of serious infringements the registers to become interconnected across the EU on 31 December 2012; • member states must notify the EC of its penalty provisions for breaking the regulation by 4 December 2011. Penalties must include suspension of the authorisation to work as a road transport operator; withdrawal of such authorisation and a declaration of unfitness of the transport manager.
The DfT has not set a date for consultation on the regulation, but it will take place this year.
