A poorly performing maintenance contractor cannot be used as an excuse for roadworthiness problems. The vehicle user always remains responsible for ensuring the vehicle is “maintained in a safe and roadworthy condition at all times when in use on the road”.

That is spelt out in Vosa’s Guide to Maintaining Roadworthiness, a useful starting point for any maintenance decisions. Equally, your drivers remain responsible for the daily walk-round check and completing defect reports diligently.

Vosa regards daily checks as just as important as scheduled safety inspections, estimating that more than 30% of the mechanical defects it spots should have been identified by the driver.
