nRAFT provisions for the regulation
of monopolies and cartels in transport have now been submitted to the Council of Ministers by the E.E.C. Commission. Transport has been excepted from the Community's monopolies rules (Regulation 17) but the new proposals will mean its inclusion from January 1, 1967.
Road, rail and inland waterway transport will be affected by the new provisions. Briefly, they involve a ban on all cartels aimed at price-fixing or introducing limiting conditions in transport arid on those which make improper use of a dominant position in the market (" monopoly positions ") or which provide for an agreed division of the market.
The regulations will exempt from the ban such arrangements as normal join; commercial operation as well as 'road/ rail or similar interworking agreements of an accepted nature.
