next March, their fitment is governed by the Road Vehicles (Construction & Use) Regulations. Their use is currently covered by the Motor Vehicles (Wearing of Seat-belts) Regulations 1993.
Under these rules all forward-facing seats in goods vehicles up to 3,500kg CO must be fitted with seat-belts which must be used, Goods vehicles exceeding 3.500kg GVW must be fitted with seat-belt anchorage points. There is no current requirement to fit seat-belts, but if they are fitted they must be used. There are a number of exemptions, including:
Using a vehicle constructed or adapted for the delivery of goods or to consumers or addressees while engaged in making local rounds of deliveries or collections. The ETA believes that journeys to or from the local delivery area would not be exempt. The courts have decided that this exemption can only apply to a person making a series of deliveries or collections; one return journey to a single point would not apply;
• Manoeuvring the vehicle, including reversing.
