r0 new decisions of the Minister of Transport on appeals lodged by James Smith and Co. (Wigan), Ltd., and Wallace Arnold Tours, Ltd., recognize the principle of linking extended tours operating under primary licences held in two traffic areas.

The appellants objected jointly to the grant by the North Western Licensing Authority of licences to continue groups of excursions and tours operated by Happiways, Ltd., with variations authorizing linking. Wallace Arnold objected to a similar grant to Shcarings Tours (Manchester), Ltd. All three appeals have been dismissed with costs.

Referring to Happiways, the Minister says: "The main issue raised on these appeals related to the vehicle allowance and to the variation of the backings, intended to regularize the linking of services originating in Yorkshire with those originating in the North Western Traffic Area. As to the vehicle allowance, the Minister finds that the Licensing Authority took steps to ensure that the linking would not lead, in effect, to any increase and that there was insufficient evidence to justify a reduction from the allowance previously granted.

" As to the linking of services, the Minister does not find that the arguments and evidence adduced in this case would justify the view that such linking is wrong in principle, or that the decision of the Licensing Authority to grant the variations asked for, pending further consideration when the licences or backings fall to be renewed, was not in accordance with the evidence or was contrary to the public interest."

In the appeal over Shearings' licence, the Minister adds that the comment by his inspector that the corridor principle in extended tours was vital, invited reference to the terms of Section 28 of the Road Traffic Act, 1934, with regard to corridor areas, and explained that there was nothing in principle to exclude from extended tours originating in one traffic area, passengers whom the applicant proposed to pick up in the adjoining one.
