• David Armishaw, who sued the North Western Traffic Commissioner Beverley Bell and a member of the Traffic Area staff over £100,000-plus in lost earnings, lost his case last Thursday Armishaw alleged loss of income after he was rejected as transport manager on a number of licence applications.
Stockport County Court struck out the three summonses and charged Armishaw costs of approximately £9,000.
In December, the North Eastern Traffic Commissioner Tom Mac,artney held that Armisnaw, who had been the nominated transport manager on multiple licences, had lost his repute as a transport manager after he failed to attend a Public Inquiry.
In his decision, the TC said that Armishaw had taken a monthly fee from operators seeking to obtain an 0-licence, in return for very limited services as a transport manager.
He had certainly not been providing the continuous and effective control required by the role.
The IC considered it unlikely that Armishaw would regain his good repute for a period of five years (CM 9-15 Jan). Armishaw will appeal to the Transport Tribunal on 3 March.
