AN APPEAL by a county council to have an operator's licence revoked on mainly environmental grounds has been dismissed by the Transport Tribunal.
West Yorkshire County Council had objected to John Gray having his restricted 0-licence renewed in June 1982. Mr Gray told the Yorkshire Deputy Licensing Authority that he would keep his operating centre at his home in Wharfedale Drive, Ilkley, West Yorkshire.
A public inquiry was held in Leeds in December 1982 at which the county council complained that there were no internal reversing facilities capable of accommodating a goods vehicle at Mr Gray's operating centre. Furthermore, the drive was intended for cars and was not suitable as a lorry park.
The council said the licence should be revoked on road safety grounds, but only one of five points made at the inquiry were connected with road safety.
Under the 1968 Transport Act, an operator cannot have his licence revoked by an LA on environmental grounds.
The DLA therefore refused the council's application and told Mr Gray he was satisfied he was a suitable person to continue to hold an 0-licence.
