AN "ABYSMAL" FAILURE to comply with undertakings at a public inquiry four years ago led to a Flintshire company's licence being cut to just one vehicle.

Buckley-based Spencer Industrial (North Wales) had been called before Welsh Traffic Commissioner David Dixon at a Flint disciplinary inquiry. When the company appeared before him in February 2001 its licence was curtailed to two vehi cles and five trailers and suspended for two weeks.

Vehicle examiner David Aitken said that since the last public inquiry six prohibitions had been issued, two of which showed serious maintenance problems.

Records checked during a maintenance investigation last autumn showed that inspection intervals were not being adhered to.

The two vehicles had received three safety inspections in 2003 and two in 2004. One trailer had two inspections in 2003 and one in 2004;a second trailer had never been inspected at all. A defect was subsequently reported by the driver on six occasions between March and May 2004. Undertakings given in relation to inspection intervals and railer brake tests at the last public inquiry had not been adhered to.

The standard of compliance could only be described as abysmal, said Aitken. He doubted that the company could ever reach an acceptable standard.

MD Henry Spencer said the vehicles were used on the demolition and scrap metal processing side of the business.His daughter had attended the previous public inquiry.lt was mainly his fault that the inspection periods had not been kept up as he had overruled his daughter due to pressure of business. He had been unaware of the gravity of that. He would ensure the vehicles were inspected at the correct intervals in future.
