Appeal dropped at last minute

MANCHESTER FREIGHTERS Ltd., Tyldesley, withdrew its appeal 24 hours before it was to be heard before the Transport Tribunal in London on Wednesday. The appeal related to the North Western deputy LA's refusal last August (CM, August 25 and September 22) to grant the conversion of one vehicle and one trailer on A licence and 17 vehicles and eight trailers on B licence, to a new A licence to carry general goods within 200 miles.
For the Transport Holding Co., which was bringing the appeal, Mr. J. S. Lawton brought forward the preliminary point of law that the new A application form dated May 16 1967 was void as far as 17 of the 18 vehicles were concerned. The original B licence was due to expire on March 24 1967 and a renewal application was received by the LA on February 13. It was adjourned by the LA so that the B licence conditions could be amended, after the refusal of the A application if Manchester Freighters so desired. This B application still stands adjourned.
This means that while the B licence renewal was still under consideration, a new A application was lodged which is contrary to Regulation 4 (3) Applications and Licenses of Goods Vehicles (Licenses and Prohibitions) Regulations 1960.
