HAULIERS FACE jail if they do not take the WTD seriously,according to a leading transport lawyer.
Leeds-based Stephen Kirkbright of Ford & Warren, told the Road Haulage Association's Working Time Directive conference that despite promises by VOSA that it will take a 'softly softly' approach to enforcing the regulations, operators should be under no illusion that if a driver is involved and they have failed to enforce the regulations VOSA will take a strong line.
-Juries have, and rightly so, a great sympathy for victims of road accidents;'he said."The road transport industry is seen as having a level of duty of care and being highly regulated therefore a breach of these standards will be taken even more seriously in court.
"Operators need to ensure they have impeccable records and procedures to protect the health and safety of their drivers. They also need to continuously monitor these standards. A breach of the regs could lead to prosecution."
