COMPANY which allowed its licence to be used ,y an unlicensed operator has had it revoked and ,oth the company and its sole director have been isqualified from holding or obtaining an 0-licence Dr 12 months Hull-based P& R National Distribution Services, /Inch held a licence for four vehicles and two trailers, nd director Kenneth O'Loughlin, were held to have Mt their repute by the North Eastern Traffic Comaissioner Tom Macartney after he concluded that he company's vehicles were being operated by East (orkshire Recycling.
The director of East Yorkshire Recycling, Stuart ,everidge, had been a director of East Yorkshire Vaste, whose licence had been revoked. A subse[uent application for a licence by East Yorkshire ?.ecycling was refused. In August Hull-based Matway, which was said to be taking on East Yorkshire Recycling's transport operation, applied for a nine vehicle licence —but this application was refused (CM 2 September 2004.) The TC was told about an unsatisfactory maintenance investigation, the issue of prohibition notices and convictions including, some for defective speed limiters and failing to hand over tachograph charts. It was said that the vehicles were not being parked at the declared operating centre but at the premises of East Yorkshire Recycling, which appeared to be using them.
Making the revocation and disqualification orders, the TC considered that P&R National Distribution had colluded with Eeveridge to allow the latter to operate goods vehicles using a false subcontracting subterfuge to circumvent the licensing regime.
