POLISH TRUCK DRIVER Janusz Sajdak has been acquitted of dangerous driving causing the death of off-duty Irish garda Gerard Carey.
Sajdak pleaded not guilty at Cork Circuit Criminal Court to dangerous driving causing death at I lpm on 28 November 2002.
Carey's Toyota car was crushed by the trailer of the artic being driven by Sajdak, the court heard. Sajdak was questioned, treated for minor injuries and discharged at the scene of the accident at Rathcormac, Co Cork.
Judge Sean O'Donnabhain last week instructed the jury to acquit, accepting the defence argument that the case could not be decided on the balance of probabilities beyond a reasonable doubt.
