THE ROAD HAULAGE Association (RHA) has successfully defended a claim for unfair dismissal from a former employee.
An employment tribunal in Croydon. Surrey, last week unanimously held that the RHA adhered to all statutory dismissal and redundancy procedures concerning the redundancy of IT systems architect Gerald Wilson.
Wilson was one of 12 staff at the R H A's headquarters in Weybridge, Surrey, informed 01126 March 2009 that they would be made redundant following a review of operations
Earlier this month, RIIA chief executive Geoff Dunning told the tribunal that the restructure had been necessary due to the organisation losing £600,000 due to the cancellation of the CV Show — of which it was a co-organiser — t, as well as having to pay £1.1m into its pension fund (CM 14 January). 2'
E Wilson told the same hearing he
believed his redundancy was "unfair and unnecessary" due to there being a continuing need for the work.
RHA director of employment Ruth Pott tells CM the association held proper meetings with the employee at all stages and followed the correct appeals procedure.
Dunning adds:"We are delighted our actions have been exonerated. We were entitled to make the changes necessary for the efficacy of our business and make staff redundant, and did so in the rightful. legal and proper manner"
Wilson tells CM he is "reviewing the decision carefully" in order to decide "the best way forward".
