Using a vehicle with a defective speed limiter has cost Normans Wirral £1,625 in fines and costs.
The Burton, South Wirralbased company pleaded guilty to seven limiter offences before the Wrexham magistrates; it was fined £220 per offence with £85 costs. Driver Carl Roberts was fined £350 with £70 costs.
Prosecuting for the Vehicle Inspectorate, Peter Edwards told the court that when Roberts' vehicle was stopped in a roadside check his tachograph chart indicated that the speed limiter was not working.
An examination of the speed limiter system showed that part of the variable link
assembly had become detached from the fuel-pump governor lever and was lying on a chassis member.
Roberts' charts showed that the maximum speed of 90km/h had been repeatedly exceeded.
The offences were pointed out to Roberts and he was asked when he had realised that the speed limiter was not functioning. Roberts had replied that it would be in the
defect book; it was an ongoing problem to be sorted as the vehicle was not pulling.
Managing director Norman Wyatt said that ever since they had bought the vehicle there had been problems with the engine not pulling. Once they had sorted that out the variable link had broken off the pump and since then the problem had got away from them.
