Which of the following most accurately describes the problem?

• No action was taken against the licence held by Bradford-based Nightspeed when the company appeared at a Leeds disciplinary inquiry before North Eastern Deputy LA Brian Homer. The company, which holds a licence for six vehicles and four trailers, appeared before the DLA following an unsatisfactory maintenance investigation.

Managing director Roy Howarth told the DLA that the other director was Lorraine McClements and the transport manager was William G Jackson. All three had previously been directors of Jackson Haulage, a company which had gone into liquidation in November 1991. He and McClements left Jackson Haulage late in October 1991 and formed Nightspeed. They could see what was going to happen and they wanted to preserve the business that Jackson Haulage was doing, some of which was very goad.

DOT vehicle examiner David Howram said that he inspected two vehicles and a trailer in November, issuing immediate prohibitions to the vehicles and a defect notice to the trailer. He concluded that inspections were not being carried out to the required standard. Howarth said the directors had placed too much reliance on their mechanic. He had been replaced and the new mechanic was more closely supervised. They had possibly been a little naive before the vehicle examiner's visit.

Homer said he was pleased to hear the company had taken firm action to ensure

its safety inspections were now on a sound footing. He was satisfied there was sufficient capital for the operation of six vehicles and four trailers.

Directing that a maintenance investigation should be made within 12 months, Horner warned that if it proved unsatisfactory he would take a much more serious Horner: No action against view of the situation. Nightspeed's licence.
