• A convicted organisation faces an unlimited fine. The court will have new powers to order that specific steps are taken to remedy the breach. It can also make a publicity order requiring the organisation to publicise the fact that it has been convicted along with specified particulars.
• Although the initial impact felt by the organisation will be the imposition of the fine, should the court consider it appropriate to order a publicity order this could have a greater prolonged effect with operators facing a loss of business in the future.
• Further, any conviction will require reporting to the Traffic Commissioner — potentially resulting in the commencement of a public inquiry where action could be taken against the firm's 0-licence.
