EXEMPTION is available from the EEC drivers' hours regulations nilk vehicles engaged on depot to depot deliveries as distinct vehicles engaged on farm to depot deliveries. This was pted by Grimsby magistrates last week.
Co-operative Wholesale ety Ltd pleaded not guilty to litting one of its drivers to insufficient weekly rest and driver, Derrick Jackson, &dad not taking sufficient rest. ephen Baggott, prosecuting he East Midlands LA, said summonses were in the re of a test case and had brought to try to clarify the position. The vehicle concerned, a flat carrying bottled milk, had been stopped in a roadside check and it was found that Mr Jackson had not had the weekly rest period as required by article 14 of the EEC regulations.
The defence argued that such vehicles were exempt under article 12, being engaged on specialised farm collection work, but Mr Baggott maintained that that exemption applied only to those vehicles actually engaged on farm collections and not to vehicles engaged on distribution work between depots.
The magistrates found the cases proved, fining the company ri 0 and giving Mr Jackson an absolute discharge.
It is understood that the company is considering appealing against the magistrates', decision.
