TWO vehicles were deleted from the four-vehicle B licence of Mr. J. T. Pennington, Liverpool, by Mr. F. Williamson, North Western Licensing Authority, last week. Last September Mr. Pennington unsuccessfully applied to vary the conditions of his licence.
Evidence given in September, when Mr. Pennington applied to carry goods for clearing houses and forwarding agents within 35 mites, clearly disclosed that the yehictes had not been in use for a long time, said M. Williamson.
F-le had called Mr. Pennington to show cause why three vehicles should not be deleted from the licence under Section 10 (3) of the 1933 Act.
It was explained by Mr. E. A. Whitehead, for Mr. Pennington, that he had taken over the business in September, 1958, after his father's death. A large part of the B-licensed work had been for the Royal Army Service Corps. The contract had finished in February, 1959, and the application to vary conditions had not been heard until September.
Mr. 'Pennington said that all the vehicles had been in use since September, but because many of the licence conditions were redundant it had been impossible td keep them fully occupied.
All the vehicles had been taxed throughout the year, and his two A-licensed vehicles had subsidized the business. He told Mr. Williamson that the vehicles had been kept licensed because " while there was life there was hope."
Mr. Williamson said that figures showed that Work done by the vehicles since September was barely enough for one vehicle. What was really needed was an alteration of conditions, but Mr. Pennington would require better evidence than that which he produced in September.
In the circumstances two vehicles would be removed from the licence, but the situation would he reviewed in nix months.
