A DRIVER EMPLOYED by Dumfries Freight who believes speed limiters are dangerous has been ordered to pay £1,115 in fines and costs for hours, tacho and speed limiter offences.
When Joseph Ha th away of Newry appeared before the Leyland magistrates he pleaded guilty to exceeding the daily driving limit, failing to take sufficient daily rest, driving for more than 41/2 hours without the required break, failing to produce tachograph charts and using a vehicle with a defective speed limiter.
Prosecuting for Vosa, John Heaton said an artic driven by Hathaway had been stopped in a check at Cuerden,Lancs.His tacho charts showed he had driven for 7hr 30min with only an 18min break. The longest period of rest in a 24hr period had been 6hr 25min.
The speed limiter was functioning correctly and the traffic examiner concluded that it had been interfered with. Hathaway had failed to produce his last tachograph chart from the previous working week.
When interviewed, Hathaway had said he wanted 'flexibility' on the speed limiter as he felt a limiter set at 56mph created bunching which endangered every road user's life.
In the light of his experience with Continental companies he had decided it was better to receive a big line for exceeding his legal hours so he could park safely, such as in a customer's compound, rather than putting himself or his female partner at risk.
