'THE Scottish Court of Sessions has held .1 that an accident in which a bus driver was badly injured was unforeseeable and absolved the Central S.M.T., Company, Ltd., Glasgow, from blame in an action for £12,000 damages. The claimant was Charles Donaghy, 65 Tobermory Road, Cathkin, Rutherglen.
Lord Walker explained that Donaghy, who was 5 ft. 3 in, in height, drove his bus into Waterloo Street bus station in June, 1958, and proceeded to change the destination board in preparation for the return journey.
This he did by standing on a foothold beside the radiator, but, as he had difficulty in reaching the handle to turn the screen and the soles of his shoes were slippery because of oil on the floor, he fell and injured his back.
As a result he was paralysed in the right leg. It was unlikely that he would ever be fit to work again.
• FARES INCREASES GRANTED THE Northern Traffic Commissioners I last week granted an application by the Northern General Transport Co., Ltd., Gateshead, tib raise their fares.
Mr. J. L. R. Croft, for Northern, said that generally, fares up to 5d. would not be increased: there would be an increase of ld. on returns between Is. and Is. 5d.; 2d. on returns from Is, 6d. to 2s. 6d.; and 3d. on fares over 2s. 6d.
The Commissioners also approved fares increases for United Automobile Services, Ltd.
