job based 26 miles from our main depot. The vehicles are working a shift system of 10-hour shifts on this job and drivers travelling to the job in the firm's van. At first we were taken down by a foreman. Now we drive the van and book travelling time, but only 10-hour shifts on our log sheets for the wagon. Therefore, are we breaking the law by doing this and would it be legal if we were not driving the van but still booking travelling time on our time sheets (12 hours inclusive of shift and travelling time)?

AYour total driving time on any working

day must not exceed 10 hours and if you drive the firm's van to or from the place where your vehicles are parked this time must be included in the 10 hours. Similarly, your total "on-duty" time in any day must not exceed 11 hours (including the 10 hours driving) and in our opinion the time spent travelling in the firm's van (even if you are not driving it) must be counted as part of the 11 hours.

If from the time of booking on at the depot to the time of booking off at the depot is 12 hours, you must take at least a total of one hour off duty during those 12 hours.
