T"appeal of Bouts-Tillotson Transport, Ltd„ against the refusal of the East Midland Licensing Authority -to grant a licence for three vehicles operating in the Nottingham district, was concluded in London, on Friday last. Mr. W. S. Morrison, K.C. M.P., for the appellant, whose opening speech lasted four days, replied to Mr. A. Tylor, who had presented the case for the respondents, Donaldson Wright, Ltd., and others.
Mr. Morrison stated that the application was for the grant of a licence for three small vehicles to be used on collection and delivery service in connection with the concern's trunk ser
vices. He suggested that the allegations made against the appellant regarding uneconomic competition, the overworking of employees and infringements of the provisions of the 1939
Act, had caused the real subject of the application to be lost sight of during the hearing of the application.
The need for the service was not discussed at the inquiry, said Mr. Morrison, but was made subsidiary to these other matters suggested by the objectors, and the proceedings disclosed a virulent attack on the applicant concern.
Counsel submitted that the decision of the Licensing Authority was founded largely on suspicion, and there was not sufficient evidence to show that there was no public need for the proposed services, neither was it shown that the services could be provided by other hauliers in the district.
The Tribunal reserved its decisf.ent, which is not likely to be announeed for three weeks.
