a driver while on the Continent do not count toward the legal limits in Britain when he is returning to base. Is this so please?
ANo, this is not correct. An appeal to the House of Lords (Lawson v Fox and others, February 12 1974) against
a decision to quash a driver's conviction for excessive duty and driving hours following a Continental trip, was upheld. The Lords held that although there was a presumption that a penal statute did nothing to make unlawful anything done abroad, that presumption was irrelevant to the offences with which the driver was charged. There was nothing in Section 96(i)(3) (a) of the Transport Act 1968 to suggest that the hours limits referred only to driving in Britain.
