A DRIVER's individual pro ductivity levels can be a legiti mate reason for selection for re dundancy, a Scottish industria tribunal has ruled in a claim o: unfair dismissal by WillianBrown Angles an employee a V.G. McD Fraser of Aberdour.
Mr Angles was one of six hg% drivers employed by thE firm,ancl when four of the si) were made redundant hE accepted the situation, but wher one was re-employed after thE new year, he decided to claim unfair dismissal.
The Tribunal ruled that at thE time of dismissal fewer drivers were needed and that Mr Angles was dismissed for reasons of re. dundancy.
There was no agreed proce. dure regarding selection, but MI Fraser used the criterion of thE respective capabilities of thE drivers. The Tribunal ruled thai in the absence of other prece. dures this method was satis factory and dismissed Mr Angles appeal.
