SOFT DRINKS manufacturers A. G. Barr & Co Ltd have been found not guilty of failing to issue a record book to a driver, and the driver himself not guilty of failing to produce a record book (CM, February 14).
During the hearing at Dunfermline Sherriff Court, the defence argued that the company was exempt from the need to provide its drivers with logbooks under the EEC legislation when they were engaged on door-todoor selling. Evidence was given that the vehicles were specially constructed for the purpose.
The prosecution had argued that the vehicles could not be regarded as purpose-built because they could be used or other work, but Sherrif J. S. Forbes accepted that thE vehicles had been designec solely with soft-drinks delivery in mind.
The Crown have been giver ten days in which to appeal.
