MAGISTRATES HAVE dismissed appeals by five drivers employed by NR Evans & Sons to save their HGV licences.The licences were suspended by Welsh Traffic Commissioner David Dixon following convictions for the falsification of tachograph records.

The drivers in question were Malcolm Brown, of Taliaris Forge, Taliaris, Llandeilo (six months' suspension); Charles Burdfield, of Pontardulais Road, Tycroes,Ammanford (five months); Michael Pocock, of Llys Llanfair, Llandovery (three months); Peter Lewis, of Pontardula is Road, Tycroes,Ammanford (two months); David Griffiths, of Coopers Estate, Ammanford (four months). For the drivers, Miles Dorrington said the TC had banned some of the drivers originally convicted in the case but not others. He appeared to have put lesser offenders off the road for longer than those with a worse record. -Where is the fairness and proportionality in that?" he asked.

Dorrington added that the drivers had only appeared in court on serious charges because VOSA had taken so long to launch the prosecution it was too late to proceed on the lesser charges of failing to keep records. The magistrates had recognised the lack of seriousness by fining the men 00 each, when they could have sent them to Crown Court where they could have facedjail.

Dismissing the appeals, the magistrates ordered each of the men to pay £50 costs
