• Road safety campaign group Brake has welcomed news that the driver who caused the Selby rail crash has failed in his first appeal against his five-year jail sentence.
Last February Gary Hart's Land Rover crashed on to the East Coast railway line when he fell asleep at the wheel while driving on the M62. Two trains smashed into his vehicle, killing six passengers and four rail employees and injuring 76, Earlier this year he was convicted of 10 charges of causing death by dangerous driving.
Hart could still take his application to a full Court of Appeal hearing before three judges.
A spokeswoman for Brake says: "We are very pleased at the decision not to grant Gary Hart leave of appeal. It shows the commitment by the civ4 justice system to take the issue of tired driving very seriously. It sends out a clear message to drivers that driving tired is a completely unacceptable risk on the roads."
