• The High Court has ruled that there should be a new inquest into the death of Stephane Aineto, who was killed when he was run over by a council refuse truck, because the original inquest should have been held in the presence of ajury.
Aineto died in July 2001 when he fell under the wheels of a dustcart, which had passed a no-entry sign to enter a pedestrianised area of Brighton. It was being operated by waste disposal firm Sita, which ran the council contract. The city coroner ruled a verdict of accidental death in December 2001, but the Frenchman's family appealed for a judicial review into the inquest (CM 22-28 Aug 2002).
Lord Justice Dyson and Mr Justice Gibbs ruled last week that "the failure to summon a jury was a serious procedural impropriety". The family's solicitor, John Halford, says the ruling is a 'huge milestone" and adds that a new inquest was necessary due to unanswered questions about Aineto's death.
