McCaffrey had appeared before North Eastern Deputy Traffic Commissioner Mark Hinchliffe to apply fora new national licence for 18 vehicles and six trailers.
Traffic examiner Kevin Barnes told the inquiry that Customs officers carried out a check at the depots of Montana Freight Services and Pallas Transport in February 2003. Thirteen vehicles were found to contain paraffin in their fuel tanks; significant amounts were also found in a 20,000litre fuel tank in the yard.
However, a letter from Customs indicated that the investigation had been completed and there was no large-scale misuse of illegal fuel. Senior Customs officer Howard Worrell admitted that the field tests carried out could give rise to false readings and this had clearly happened with one vehicle on this occasion.
The DTC commented that either there was a huge fundamental flaw in the tests carried out: or the operator was trying to undermine the 0-licensing system. He called for independent joint tests on the samples still held by Customs before making a decision.
