CHARD HOGG, of 14 Henrson Street Leith, failed in application for wrongful ;missal against Dunvan nstruction Co of Edinburgh whom he operated as a Lver labourer, for a squad n. On 17th September he Ls off sick and had a medical rtificate for seven days; ablce subsequent to 24th Sepnber was not covered by the rtificate. The firm decided st because of unreliability ey should employ another ver and engaged one during Hogg's absence; he was ered a more static job at ;htly less money as against £120 per week he had been -fling. He at first appeared to :..ept the position but then itched and told the :ployer to have his "books" Ld'y on the Friday. This was :en as notice of termination employment.
The employer said he was an :ellent worker and would be prepared to put up with ab.sences if they were covered for their driving needs. This was seen by the Tribunal to be wholly reasonable. The company had made one proposal which the applicant refused. They then made another suggestion which the applie.ant should have accepted. The claim was dismissed.
