FIRST round in a battle with the South Eastern Traffic Commissioners was lost by a public house in Shoreham, Sussex last month.
The Amsterdam, which has been operating a no fares get-you-home bus service since February, was fined a nominal El for operating a bus without a psv licence.
The prosecution contended that the bus was not run as a social kindness, but was, in fact, part of business as customers were paying fares in the profits made on the sale of meals and drinks.
The Commissioners advised the Amsterdam's managing director that he could run the bus, provided no fares were charged. They then decided to bring a test case against the pub to clarify issues involved.
The public house is to appeal against the magistrates' decision.
