A CASE described as being "of vital interest to all minibus drivers came before the Market Harborough magistrates last week, when Edward Lloyd Hibberd, a farm foreman, was fined I:4 for speeding.
Hibberd admitted having driven at 45-48 m.p.h. in an unrestricted area, but Mr. D. Hutchinson, his solicitor, submitted that on a point of law, the minibus was not subject to speed restrictions except in built-up areas.
Mr.. H. V. Jackson, prosecuting, said the regulations laid down that any vehicle weighing over three tons and constructed to carry more than seven passengers was subject to the speed limit.
There had been seven passengers in the minibus when it was stopped. It was constructed to carry 12. Hibberd said in evidence that the vehicle weighed only 1 ten 5 cwt. 14 lb. and nothing had been done to alter its construction.
The magistrates said that as at present constructed, the minibus weighed less than three tons, but it was liable to the speed limit because it was constructed to carry more than seven passengers.
