• In a written decision, the Transport Tribunal has refused the appeal of John Hill and Sons (Walsall) Ltd. against the action taken by the West Midland LA under section 178 (See CM December 20).
After a public inquiry the LA announced that he proposed to suspend two vehicles for a period of 28 days from October 21 1968, and by a letter dated October 15 he specified the vehicles as being one with a carrying capacity of 12 tons and one with a carrying capacity of 20 tons.
It appeared to the Tribunal that the LA selected the vehicles for suspension in such a way that the suspension would affect all the commodities mentioned in the conditions attached to the appellant's licence, but would not prevent the appellant from carrying any of those commodities during the period of suspension.
The Tribunal felt that the direction given by the LA was a fair one and subsequently dismissed the appeal. The curtailment will be effective from January 14.
