:ONFUSION over a Hull operator's depot arrangements led he Transport Tribunal to refer the case back to the Yorkshire )eputy Licensing Authority.
Michael Harding, trading as iun Ray Motors, was appealing igainst the DLA's decision to evoke his licence after receiving letter which suggested that his gemises did not comply with he standards laid down by the 1968 Transport Act and 1974 iciad Traffic Act.
The Tribunal heard that the 'orkshire LA's doubts about the operating centre were founded on imprecise details in Mr Harding's 1 977 application for an 0-licence under the name of Jackson of Hull (Haulage) Ltd.
Information which subsequently came to light at a public inquiry satisfied the DLA that the yard was used extensively for storage, and that there was insufficient room for it to be used as an operating centre.
In the course of giving evidence, Mr Harding told the DLA that he had an office elsewhere in Hull, but gave no further details.
The Tribunal suspects that this meant he had no other premises, and that his operating centre was his office, and it has asked the DLA to take further evidence and reach a decision in the light of the 1976 RHA v Cash and McCall case,
