A N application by Frank Mackay Ltd., of Aberdeen, for a four-vehicle switch from Contract A to A licence was refused by the Scottish deputy Licensing Authority, Mr. A. B. Birnie, at Aberdeen last week. A similar application wa's refused some 12 months ago.
The current licence, which had been in force for three years, was authorized on contract to the Fettercairn Potato Co. Mr. Frank Mackay, a director of both companies, said that the vehicles were not fully employed and over a year were used to only two-thirds capacity. Four farmers in the Fettercairn area spoke of their needs and said that the spare capacity which would be available if granted could be utilized by them. The application was opposed by seven hauliers in Kincardine and Aberdeen and by British Railways and British Road Services.
In refusing the application, Mr. Birnie quoted at length from the Merchandise Transport case and said that the appropriate licence to be applied for in this case was, to his mind, a B.
