MAGISTRATES who refused police a summons against Doncaster lorry driver after .ciding that his alleged breach EEC Regulation 543/69 was r an offence under English la have been over-ruled by ti High Court judges in London.
Ordering the St Helens, M seyside, magistrates to issue t Summons, Lord Justice Dona son, presiding in the Queei Bench Divisional Court, said tt they had "misconceived" th duty. Mr Justice Hodgs, agreed that a police appi against the Magistrates` de sion should be allowed.
The driver who will receive t summons is Christoph Spencer of the Haywagon Ca van Site, Adwick-le-Street, Dc caster, who is accused breaching instruction 10 of Ai cle 14 (1) of EEC Regulati 543/69, The Regulation requires h to enter his name, date of bil and address on the front co% of his driver's individual cont book.
