LONG-SERVING driver with a jood record, sacked because he
as found asleep in his cab at us distillery delivery point, has lad his claim for unfair dismis;al refused by the Scottish Iniustrial Tribunal.
The tribunal heard that the .:ompany rule, that a driver who lad signed a no-drinking clause Nould be instantly dismissed if le was in breach of his contract.
Walter Pennicuik had been 5een driving slowly, and this Nas reported to the transport -nanager who found him asleep at the delivery point.
He admitted drinking two pints of beer while taking antihistamine tablets.
In refusing the claim, the Triaunal said that the rule against oeing found intoxicated should oe strictly enforced and that Mr Pennicuik's conduct was a reasonable reason for his dismissal.
