Tw°points of law arose when Messrs. C. and G. Yeoman, Canterbury, applied to the Transport Arbitration Tribunal, this week, for confirmation of an agreement with the Road Haulage Executive concerning compensation.
The first question was whether goodwill was property under the terms of Section 47 (2) of the Transport Act, and entitled the holder to compensation in addition to that paid for cessation of business under Section 47 (3).
The Yeoman undertaking had been carried on as a partnership, and the second point was whether, in assessing net profit for the purposes of calculating compensation under Section 47 (3), it was proper to deduct an amount equivalent to the economic value of the services of the partners.
A substantial sum had been agreed upon, but this may he changed when the Tribunal has considered the matter and heard all counsels' , arguments. The case is to be resumed.
